Terms of Service

By using MY.TUNZ ("the app", "we", "our"), you agree to the following terms. If you do not agree, do not use the app.

1. What We Do

MY.TUNZ is an AI-powered song creation service. You provide a description, genre, and mood, and we generate a unique song using artificial intelligence (lyrics via a third-party AI text generation provider, and music via a third-party AI music generation provider). Songs are delivered as streaming audio.

2. Song Credits and Payments

• Song creation requires a song credit, purchased through our payment provider.
• Credits are non-refundable once used to generate a song.
• Unused credits expire 24 months after the date of purchase. Using any credit from an order extends the expiry of the remaining credits in that order by a further 24 months from the date of that use.
• Each credit produces one song. If generation fails due to a system error on our end, the credit will not be consumed.
• Prices are listed in USD and may change at any time. Existing purchased credits are not affected by price changes.

3. Song Ownership and Usage

• Songs are generated by AI and may not qualify for copyright protection in all jurisdictions.
• You are free to use your generated songs for personal, non-commercial purposes (sharing with friends, social media posts, personal events).
• Commercial use (selling the song, using it in ads, distributing on streaming platforms for revenue) is not guaranteed to be legally protected and is done at your own risk.
• We do not claim ownership of songs generated for you.

4. Song Availability

• Once your song is generated we store a copy on our own storage and serve it from our own domain, so it stays available in My Songs rather than depending on how long an AI provider keeps it.
• We intend to keep your songs available for as long as we operate the service, but we do not guarantee indefinite availability and we may change this with notice.
• We recommend downloading any song you want to keep independently of the service.
• We are not liable for songs that become unavailable after delivery.

5. Acceptable Use

You agree not to:

• Use the app to generate content that is hateful, violent, sexually explicit, or illegal.
• Attempt to overload, hack, or reverse-engineer the app.
• Use automated tools or bots to access the service.
• Resell song credits or access to the app.

We reserve the right to refuse service or revoke credits without refund if these terms are violated.

6. AI-Generated Content Disclaimer

• Songs are generated by AI models we do not fully control. Output may occasionally be unexpected, repetitive, or of varying quality.
• We do not guarantee that generated content is free from similarity to existing copyrighted works.
• You use generated content at your own risk and are responsible for reviewing it before sharing publicly.

7. Limitation of Liability

The app is provided "as is" without warranties of any kind. To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, or consequential damages arising from your use of the app.
• Our total liability for any claim is limited to the amount you paid for the specific credits in question.
• We are not responsible for third-party service outages (AI providers, payment processors, hosting) that may affect song generation or delivery.

8. Service Availability

We aim to keep the app running but do not guarantee uninterrupted service. We may modify, suspend, or discontinue the app at any time. If we permanently shut down, unused credits will be refunded where reasonably possible.

9. Changes to These Terms

We may update these terms at any time. Continued use of the app after changes constitutes acceptance. We will update the "Last updated" date above when changes are made.
